Scope of Application

The following General Terms and Conditions govern all services provided by ESTE TRAVEL. Deviating conditions shall only be valid if expressly confirmed in writing by ESTE TRAVEL. A contract is concluded exclusively through written confirmation by ESTE TRAVEL.

Scope of Services

All offers by ESTE TRAVEL are non-binding and subject to change. Only our written order confirmation shall be binding. Oral agreements or commitments by telephone shall only be valid if confirmed in writing by ESTE TRAVEL. All prices are stated in euros and include statutory VAT, unless expressly indicated otherwise. ESTE TRAVEL assumes no liability for any printing or typographical errors.

Passengers who disregard instructions, obstruct the driver, or endanger traffic safety in accordance with the German Road Traffic Regulations (StVO) may be excluded from further transportation by ESTE TRAVEL. In such cases, the customer remains liable for the full agreed fare, including all additional and special services.

Airport Pickup (Airport Transfer)

Any change to the previously agreed pickup time must be reported to ESTE TRAVEL immediately. Damages resulting from delayed or omitted notifications shall be borne by the customer.
The chauffeur will meet the passenger at the agreed meeting point (e.g., airport meeting point) with a name sign or company logo and will wait up to 120 minutes at no additional cost. A phone number for contacting the chauffeur will be provided to the customer in advance. If no contact is made with the passenger after the 120-minute waiting period, ESTE TRAVEL may consider the trip canceled and charge the full agreed fare. Additional waiting time will be charged according to the current price list.

Prices

All stated prices include statutory VAT. The applicable prices are those in effect at the time of the written booking confirmation. Any flat rates not listed in the price list must be agreed upon separately in writing. Additional costs resulting from delays or detours caused by the customer or unforeseeable circumstances shall be borne by the customer in accordance with the current price list. The fare generally includes passenger transport with normal luggage. Bulky or unusual items must be agreed upon separately in advance.

Payment Terms

For journeys not starting in Innsbruck, ESTE TRAVEL is entitled to request an advance payment of up to 100% of the total price up to 24 hours before the start of the trip. Valid credit card details (Visa or Mastercard) must be provided as payment security. Any remaining balance is due at the latest at the start of the trip and payable to the chauffeur. Payments may be made in cash, by credit card, or by debit card if agreed in advance. In the event of late payment, ESTE TRAVEL will charge default interest at 4% above the base interest rate. From the second reminder onwards, reminder fees of €10 will apply. The customer is entitled to prove that lesser damages have occurred.

Cancellations and Withdrawal

Cancellations must be made in writing (via email). The date of receipt by ESTE TRAVEL is decisive for compliance with the deadline.
The cancellation fees are as follows:
• Up to 12 hours before the start of the trip: 50% of the agreed price
• Up to 3 hours before the start of the trip: 80% of the agreed price
• Less than 3 hours before the start of the trip or no-show: 100% of the agreed price

The customer is entitled to prove that ESTE TRAVEL incurred lower or no damages.

Customer’s Obligations and Liability

The customer is obliged to inform ESTE TRAVEL immediately of any changes regarding name, phone number, time, or location of the service. Failure to do so will make the customer liable for resulting damages. Furthermore, the customer agrees not to misuse ESTE TRAVEL’s services, in particular by:
• causing damage,
• disturbing or endangering other persons,
• violating legal regulations,
• smoking in the vehicle,
• refusing to pay the agreed price.

In the event of violations, ESTE TRAVEL is entitled to take necessary measures and, if applicable, claim damages.

ESTE TRAVEL’s Liability

ESTE TRAVEL is liable solely within the framework of statutory provisions and only for damages directly related to the services provided. In particular, ESTE TRAVEL assumes no liability for missed departure times and resulting consequential damages (e.g., missed connecting flights or trains) if these are due to traffic jams, roadworks, road closures, or other unforeseeable traffic conditions. Liability is also excluded for luggage, electronic devices, animals, or other items in the vehicle. ESTE TRAVEL assumes no liability for damages resulting from incorrect data transmission by the customer.

Place of Performance and Jurisdiction

The place of performance for all services is the registered office of ESTE TRAVEL, Altmahd 133, 6134 Vomp. All legal disputes shall be subject exclusively to the court having jurisdiction over the registered office of ESTE TRAVEL.

Applicable Law

Austrian law shall apply exclusively. The applicability of the UN Convention on Contracts for the International Sale of Goods is excluded. The contract language is German.

Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. In place of the invalid provision, a regulation shall apply that comes as close as possible to the economic purpose of the invalid provision.
